Terms of Service

These Terms of Service ("Terms") govern your access to and use of USRiskMap ("we," "us," or "our"), including usriskmap.com and related websites, apps, maps, alerts, and tools (the "Service"). By creating an account, clicking to accept, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Informational use only

USRiskMap aggregates and displays publicly available and third-party hazard, weather, and risk data for informational and educational purposes. The Service is not professional safety, engineering, financial, insurance, legal, or emergency-response advice. Data may be incomplete, delayed, outdated, or unsuitable for life-safety or property decisions. During an emergency, follow instructions from local authorities and the National Weather Service.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or that pose risk to the Service or other users.

3. Email and SMS alerts

The Service may offer optional email and SMS (text) alerts about hazards, conditions, or preparedness related to locations or preferences you configure.

  • Enrollment. By providing an email address or mobile number for alerts and completing any confirmation steps we require, you expressly consent to receive automated messages at that contact, including messages sent by autodialer or similar technology where permitted by law. Consent is not a condition of purchasing any good or service unless we clearly state otherwise.
  • Frequency and cost. Alert volume varies with weather, hazards, and your settings. Standard message and data rates from your carrier may apply. Delivery is not guaranteed.
  • Opt out. You may cancel SMS by replying STOP (or as otherwise instructed) or by updating account preferences. You may unsubscribe from non-essential email using the link in the message or by contacting us. Opting out of alerts does not cancel your account unless you also close the account.
  • Your responsibilities. You must own or control the contact channels you register, keep them current, and not use alerts for unlawful purposes. You understand that alerts are supplemental only and must not be relied on as your sole source of emergency warning.
  • Providers. We may use third-party email and SMS providers to deliver messages. Their networks and policies are outside our full control.

4. Acceptable use

You agree not to:

  • Misuse the Service, attempt unauthorized access, or disrupt its operation;
  • Scrape, bulk-download, or redistribute map or alert data except as we expressly allow;
  • Use the Service for unlawful, harmful, or misleading purposes; or
  • Misrepresent your identity or affiliation when using alerts or accounts.

5. Intellectual property

The Service, including software, branding, and original content, is owned by USRiskMap or its licensors. Third-party data and basemaps remain subject to their providers' terms and attributions (see About / data sources). You receive a limited, non-exclusive, non-transferable license to use the Service for personal or internal informational purposes in accordance with these Terms.

6. Third-party links and affiliates

The Service may link to third-party sites or products, including affiliate offers. We are not responsible for third-party content, policies, or transactions. Affiliate disclosures are described on our affiliate disclosure page.

7. Indemnification; hold harmless

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless USRiskMap and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service or any email/SMS alerts; (b) your reliance on maps, data, forecasts, scores, or notifications; (c) your violation of these Terms or applicable law; (d) your content or locations submitted to the Service; or (e) any dispute between you and a third party relating to the Service. We reserve the right to assume exclusive defense of any matter subject to indemnification, at your expense, and you agree to cooperate with that defense.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY ALERT WILL BE TIMELY, ACCURATE, COMPLETE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, USRISKMAP AND ITS AFFILIATES AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

10. Changes and termination

We may modify the Service or these Terms at any time. Material changes will be posted with an updated date. Continued use after changes take effect constitutes acceptance. We may suspend or discontinue the Service (or alerts) without liability. You may stop using the Service at any time and may request account closure by contacting us.

11. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply. Courts in that state will have exclusive jurisdiction over disputes, subject to applicable law.
